Privacy Policy

1. Who we are

This Privacy Policy applies to the use of DateRegister (dateregister.nl, dateregister.be, consentregister.nl) and BDSMRegister (bdsmregister.nl, bdsmregister.be, bdsmregister.com), hereafter "the Service". The data controller for your personal data is:

2. What data we process

We process the following categories of personal data, depending on how you use the Service:

  • account data: email address, password (stored encrypted), profile name, preferred language;
  • profile data you fill in yourself: bio, interests, profile photo, gender, birth date (only the computed age is ever shown publicly), country/province/city, height, smoking habits, tattoos/piercings, hair/eye color, build, education level, and — where applicable — your BDSM role and kink preferences;
  • data about proposed and recorded events: the name of the invited person, an optional date, and the content of your consent record (including a safeword, comfort notes, and answers to the checklist about what's agreed);
  • media you upload: photos, videos and stories you post to the gallery;
  • technical data: IP address (for example for error reporting and security), timestamps, and cookies (see article 8).

3. Special categories of personal data

The nature of the Service means we may process special categories of personal data within the meaning of the GDPR, in particular data about sexual behavior and sexual orientation — for example your BDSM role, kink preferences, and the content of a consent record. We process this data solely on the basis of your explicit consent, which you give by actively entering this information yourself. You can withdraw this consent at any time by deleting the relevant data or closing your account.

4. Why we process this data

We process your data on the basis of the following legal grounds:

  • performance of the contract: to create an account, log in, and deliver the Service's core functionality (including recording and displaying consent);
  • explicit consent: for special category data (article 3) and for showing your profile, kink preferences and media to other users;
  • legitimate interest: for security, fraud prevention, and operating and improving the Service;
  • legal obligation: where applicable, for example in response to a lawful request from a law enforcement authority.

5. How long we keep data

We keep your data for as long as you have an account. When you delete your account, we delete your personal data, with two exceptions: (1) data we are legally required to keep longer, and (2) consent records where the other user involved still has an active account — because that record also serves as safety evidence for that other user, and deleting it solely because you closed your account would undermine their protection. This exception is not yet supported by an automated deletion or export process (see article 10) — contact privacy@maran-it.nl for a tailored request.

6. Who we share data with

We do not share your data with third parties to sell it or for their own marketing purposes. We host the Service and the database ourselves, on our own infrastructure — so no external hosting provider is involved. We do use the following processor:

  • Brevo, to send transactional emails (such as confirmation emails and invitations) — we only pass Brevo your email address, and none of your other data.

A data processing agreement is, or will be, in place with this party in line with the GDPR. Any advertising embed an administrator places on the Service is not monitored by us for that third party's own data processing — that party's own privacy policy applies to that specific interaction.

7. Transfers outside the EU

We try to choose processors located within the European Economic Area wherever possible. To the extent a processor handles data outside the EEA, we ensure appropriate safeguards, such as the EU Standard Contractual Clauses.

8. Cookies

We use the following types of cookies:

  • a login cookie, to keep you signed in;
  • a language cookie, to remember your language preference;
  • a security cookie (antiforgery token), to protect forms against abuse.

We don't use tracking or advertising cookies of our own. All of these cookies are strictly necessary for the Service to function and are therefore not subject to cookie consent requirements.

9. Security

We take appropriate technical and organizational measures to protect your data, including encrypted connections (HTTPS), encrypted password storage, and limited access to personal data within our team. No system is ever fully secure, though; in the event of a data breach that poses a risk to you, we will inform you in line with the GDPR.

Profile photos and gallery photos/videos are also shown blurred by default to anyone who isn't logged in — the sharp version only appears once you're logged in. This is an extra protective measure, precisely because we don't apply identity verification (see article 11) and can't guarantee who a logged-out visitor actually is.

10. Your rights

Under the GDPR you have the following rights regarding your personal data: access, rectification, erasure, restriction of processing, objection, and data portability. Right now you can manage and delete your account and most of your own data yourself via your profile; for other requests (such as a full data export) you can reach us at privacy@maran-it.nl — we currently handle these requests manually, pending automated tooling. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

11. Minors

The Service is not intended for anyone under 18. At registration we ask for your own declaration that you are 18 or older, but we do not verify this using an identity document (see also our Terms and Conditions). If you suspect an account belongs to a minor, please report it to privacy@maran-it.nl.

12. Changes

We may amend this Privacy Policy. In case of a material change, we will inform users beforehand, for example by email or via a notice within the Service, before the change takes effect.

This privacy policy was drafted in Dutch. In the event of any discrepancy between this Dutch text and a translation into another language, the Dutch text is binding.
