Terms and Conditions

1. Who we are
These Terms and Conditions apply to the use of DateRegister (dateregister.nl, dateregister.be) and BDSMRegister (bdsmregister.nl, bdsmregister.be, bdsmregister.com), hereafter "the Service". The Service is provided by:

hereafter "we", "us" or "the Provider".
By creating an account or using the Service, you agree to these terms.
2. What the Service is — and isn't
2.1. The Service lets users record, between themselves, a moment at which each of them, individually, indicated agreement to something (a "record"). A record is a factual log of what was entered, nothing more and nothing less.
2.2. No rights can be derived from a record made through the Service. In particular:
- A record is not an agreement, contract or legal act between the Provider and its users, and the Provider is in no way a party to whatever users arrange between themselves.
- A record is not legal proof that consent was validly, freely, knowingly, or continuously given, and offers no guarantee that what was recorded matches reality, what actually happened, or what still applied at the relevant moment. Consent can be withdrawn at any time, even after a record was made.
- A record creates no obligation for a user to proceed with what was recorded, and provides no legal remedy, claim, or right of recourse — not against the other user, and not against the Provider.
- The Provider does not verify whether what was recorded actually took place, and makes no statement whatsoever about its accuracy, completeness, or legal validity.
2.3. The Service is intended as an aid to communication between users about mutual expectations, not as a substitute for legal advice, victim support, or reporting a (suspected) criminal offense to the police. If you suspect a criminal offense has occurred, we recommend reporting it to the police; we are not a body with, or exercising, investigative authority.
3. Identity, age and verification
3.1. At registration we ask for your own declaration that you are 18 years or older. We do not verify this using an identity document or otherwise, nor do we verify any other information a user enters about themselves (name, photo, location, role, preferences).
3.2. You are solely responsible for independently establishing the identity, age and legal capacity of any other user before you meet them or record anything with them. We are not liable for damage resulting from incorrect, incomplete or misleading information another user has provided about themselves.
4. Uploaded media and other content
4.1. When you post photos, videos, text or other content through the Service ("Content"), you remain the owner of that Content. You grant the Provider a non-exclusive, worldwide, royalty-free right to store, process and — to the extent you have configured this yourself — display that Content within the Service to other users, solely for the purpose of operating the Service.
4.2. Responsibility for the rights to uploaded Content lies entirely with the uploader. By uploading Content, you declare that:
- you own the copyright in the Content yourself, or hold all necessary permissions and licenses to upload it and have it displayed within the Service;
- if anyone other than yourself is recognizable in the Content, you have their express consent to depict and publish them in this way (image/portrait rights);
- the Content does not infringe the rights of third parties and is not otherwise unlawful, including in any case content involving minors, content produced or distributed without the consent of the person depicted, and content that is otherwise unlawful or a criminal offense.
4.3. Uploaded Content is manually reviewed by us before it becomes visible to other users ("moderation"). This review is solely a check for visible compliance with our guidelines (such as obvious illegality) and does not in any way constitute a legal review or a guarantee that the uploader actually holds the required rights. Our approval does not release the uploader from the responsibility set out in 4.2, and does not shift that responsibility to us.
4.4. You indemnify the Provider against third-party claims related to a breach of 4.2, including reasonable legal costs.
4.5. We reserve the right to reject Content without giving reasons, to alter how it is displayed (such as blurring, see our Privacy Policy), or to remove it, and to suspend or terminate an account in case of (suspected) violation of these terms.
5. Prohibited use
You may not use the Service to:
- post or share content involving minors, in any form;
- post images or video of a person without their consent;
- create an account under an identity other than your own, or create multiple accounts to deceive others;
- harass, stalk, blackmail, or pressure another user;
- use the recording feature to create a false or misleading impression of consent;
- engage in any other use that violates applicable law or regulation.
In case of a violation we may suspend or remove an account immediately, without prejudice to our right to report the matter to the authorities or otherwise take legal action.
6. Liability
6.1. The Service is provided "as is". We make reasonable efforts to operate it carefully, but do not guarantee that it is free of errors, uninterrupted, or available at all times.
6.2. We are not liable for:
- the acts or omissions of users towards one another, even where those acts deviate from what was recorded through the Service;
- damage arising from the use of, or reliance on, information entered by other users;
- indirect damage, consequential damage, lost profit or non-material damage, except in case of intent or deliberate recklessness on the part of the Provider.
6.3. Without prejudice to article 6.2, any liability of the Provider for damage of any kind, on any basis whatsoever, is excluded, for any amount whatsoever.
6.4. Nothing in these terms limits liability to the extent this is not permitted under mandatory law.
7. Intellectual property in the Service
All rights in the Service itself — including the software, the brand names "DateRegister" and "BDSMRegister", its design and texts (excluding Content posted by users) — belong to the Provider. Nothing in these terms transfers any of these rights to the user.
8. Personal data
The processing of personal data is governed by our separate [Privacy Policy]. Given the nature of the Service, special categories of personal data may be processed (including data about sexual orientation or preferences); see the Privacy Policy for the legal basis and retention periods that apply.
9. Paid features
To the extent the Service includes paid components, the prices and terms published at that time apply to those components. Payment unlocks only the described functionality and grants no additional rights beyond what is set out in article 2.
10. Termination
10.1. You may delete your account at any time.
10.2. We may suspend or terminate an account in case of a violation of these terms, on the basis of a legal obligation, or — with reasonable prior notice — because we discontinue the Service.
11. Changes
We may amend these terms. In case of a material change, we will inform users beforehand, for example by email or via a notice within the Service, before the change takes effect.
12. Governing law and disputes
These terms are governed by Dutch law. Disputes will be submitted exclusively to the competent court in Rotterdam, including — insofar as applicable — the Rotterdam cantonal court (kantongerecht), unless mandatory law provides otherwise.
